Casual Taxable Person

Casual Taxable Person as per Model GST Law (section 2(21)

(21) “casual taxable person” means a person who occasionally undertakes transactions involving supply of goods and/or services in the course or furtherance of  business whether as principal, agent or in any other capacity, in a taxable territory where he has no fixed place of business;

Compulsory Registration of  Casual Taxable Person under GST [ schedule III of Model GST Law]

The following categories of persons shall be required to be registered under this Act:

(i) persons making any inter-State taxable supply, irrespective of the threshold specified under paragraph 1;

(ii) casual taxable persons, irrespective of the threshold 

(iii) persons who are required to pay tax under reverse charge, irrespective of the threshold

(iv) non-resident taxable persons, irrespective of the threshold.

(v) persons who are required to deduct tax under section 37;

(vi) persons who supply goods and/or services on behalf of other registered taxable persons whether as an agent or otherwise, irrespective of the threshold .

(vii) input service distributor;

(viii) persons who supply goods and/or services, other than branded services, through electronic commerce operator, irrespective of the threshold ;

(ix) every electronic commerce operator, irrespective of the threshold specified in paragraph 1;

(x) an aggregator who supplies services under his brand name or his trade name, irrespective of the threshold ; and

(xi) such other person or class of persons as may be notified by the Central Government or a State Government on the recommendations of the Council.

GST Registration form for Casual Taxable Person

GST REG 01  is common GST Registration Application form for Registration under Section 19(1) of Goods and Services Tax Act, 20–

A person applying for registration as a casual taxable person shall be given a temporary identification number by the Common Portal for making advance deposit of tax under section 19A and the acknowledgement shall be issued electronically thereafter.

Application for extension of GST registration period by Casual / Non-Resident taxable person.

Form GST REG 25 has been Specified for Application for extension of registration period by Casual / Non-Resident taxable person.

Where a registered casual taxable person or non-resident taxable person intends to extend the period of registration indicated in his application of registration, an application in Form GST REG-25 shall be furnished electronically through the Common Portal either directly or through a Facilitation Centre, notified by the Board or Commissioner by such person before the end of the validity of registration granted to him.

The application under shall be acknowledged only on payment of the amount specified in sub-section (2) of section 19A.

 Validity period of the Registration certificate issued to a Casual Taxable Person and non Resident Taxable person

The certificate of registration issued to a “casual taxable person” or a “non-resident taxable person” shall be valid for a period of ninety days from the effective date of registration. However, the proper officer, at the request of the said taxable person, may extend the validity of the aforesaid period of ninety days by a further period not exceeding ninety days.

Advance tax to be paid by a Casual Taxable Person and Non-resident Taxable Person at the time of obtaining Registration under this Special Category

While a normal taxable person does not have to make any deposit of money to obtain registration, a casual taxable person or a non-resident taxable person shall, at the time of submission of application for registration under sub-section (1) of section 19, make an advance deposit of tax in an amount equivalent to the estimated tax liability of such person for the period for which the registration is sought. If registration is to be extended beyond the initial period of ninety days, an advance additional amount of tax equivalent to the estimated tax liability is to be deposited for the period for which the extension beyond ninety days is being sought.

 Special provisions relating to casual taxable person and non-resident taxable person [Section 19A]

(1) The certificate of registration issued to a casual taxable person or a non-resident taxable person shall be valid for a period of ninety days from the effective date of registration. Provided that the proper officer may, at the request of the said taxable person, extend the aforesaid period of ninety days by a further period not exceeding ninety days.

(2) Notwithstanding anything to the contrary contained in this Act, a casual taxable person or a non-resident taxable person shall, at the time of submission of application for registration under sub-section (1) of section 19, make an advance deposit of tax in an amount equivalent to the estimated tax liability of such person for the period for which the registration is sought: Provided that where any extension of time is sought under sub-section (1), such taxable person shall deposit an additional amount of tax equivalent to the estimated tax liability of such person for the period for which the extension is sought.

(3) The amount deposited under sub-section (2) shall be credited to the electronic cash ledger of such person and shall be utilized in the manner provided under section 35.
