Eligible to be enrolled for the Aadhaar number
As per the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, only a resident individual is entitled to obtain Aadhaar.
As per Section 3 of the said act :-
“Aadhaar number
3. (1) Every resident shall be entitled to obtain an Aadhaar number by submitting his demographic information and biometric information by undergoing the process of enrolment:
Provided that the Central Government may, from time to time, notify such other category of individuals who may be entitled to obtain an Aadhaar number. “
As per Section 2(v) of the said act : Resident means an individual who has resided in India for a period or periods amounting in all to 182 days or more in the 12 months immediately preceding the date of application for enrolment.

When not required to link Aahaar with PAN :
The requirement to quote Aadhaar as per section 139AA of the Income-
tax Act shall not apply to an individual who is not a resident as per the Aadhaar Act, 2016.
